Acceptance
The site is operated by Wear Harmo and its subsidiaries. Your use of the site is conditioned upon your acceptance and compliance with the terms, conditions, notices, and disclaimers set forth below ("Terms and Conditions"). Your use of the site constitutes your agreement to the Terms and Conditions.
Wear Harmo and its subsidiaries reserve the right to alter the Terms and Conditions at any time without prior notice. Your continued use of the site after any changes become effective constitutes your agreement to comply with and be bound by the modified Terms and Conditions.
Capacity
Products on the site are available for sale only to individuals who are legally capable of entering into binding contracts.
Orders
Any order placed by you in the manner described on this site is your offer to purchase a specific product at the price (including delivery and other fees and taxes) specified on this site at the time you place your order under these Terms and Conditions. Once an order is processed, it cannot be canceled. Wear Harmo and its subsidiaries reserve the right to accept or reject your offer for any reason, including but not limited to the unavailability of any product, an error in the price or description of the product posted on this site, or an error in your order. Your contract with us only comes into effect when we send you confirmation of receipt of your order and payment.
Prices
The prices of products and services, delivery, and other fees displayed on this site are current at the time of issuance but may change at any time and are subject to availability.
Goods and Services Tax ("GST") and Other Taxes
Prices displayed on this site include GST applied at the rate of 10%.
Wear Harmo and its subsidiaries will retain the title to the products you order until you have made full payment for those products, but all risk in the products will pass to you upon delivery or collection by a postal service or express delivery service. You should consider whether to obtain appropriate insurance.
Refunds and Returns
The circumstances under which we are required to issue a refund or return are detailed in our Return Policy.
Limitation of Liability
Wear Harmo and its subsidiaries will not be liable in any way for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the site, or for the cost of procuring substitute products, or resulting from any products purchased or obtained, or messages received, or transactions conducted through the site, or resulting from unauthorized access to or alteration of your transmissions or data, or any information contained on this site, including but not limited to damages for loss of profits, use, data, or other intangibles, even if we have been advised of the possibility of such damages.
When any Act of Parliament implies in the Terms and Conditions any term, condition, or warranty, and that Act prohibits or restricts provisions in a contract that exclude or modify the application of, or liability under, such term, condition, or warranty, such term, condition, or warranty will be deemed included in these Terms and Conditions, but our liability for any breach of such term, condition, or warranty will be limited, at our discretion, to one or more of the following:
If the breach relates to goods:
- The replacement of the goods or the supply of equivalent goods;
- The repair of such goods;
- The payment of the cost of replacing the goods or acquiring equivalent goods; or
- The payment of the cost of repairing the goods.
If the breach relates to services:
- The re-supply of the services; or
- The payment of the cost of having the services re-supplied.
Gift Cards
Gift cards purchased online are valid for 6 months from the date of purchase. Gift cards cannot be redeemed after expiration.
Mobile Service Terms
The mobile messaging service of Wear Harmo and its subsidiaries (the "Service") is operated by Wear Harmo and its subsidiaries ("Wear Harmo and its subsidiaries," "we," or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without prior notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service after the effective date of any such changes constitutes your acceptance of those changes.
By opting in to the Wear Harmo and its subsidiaries SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Wear Harmo and its subsidiaries via your wireless carrier to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you are not required to opt-in to this program to make any purchases, and your consent is not a condition for any purchase with Wear Harmo and its subsidiaries. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all fees and charges associated with text messaging imposed by your wireless carrier. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless carrier for details. You are solely responsible for all charges related to SMS/text messaging, including charges from your wireless carrier.
You may opt out of the Service at any time. Click the unsubscribe link (when available) in any text message to cancel. You will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless initiated by you. If you have subscribed to other Wear Harmo and its subsidiaries mobile messaging programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.
